Terms of Service

1. Acceptance

By creating an account or using Get Ahead Gifts ("the Service"), you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

2. What the Service is

Get Ahead Gifts is a personal reminder tool that helps you track the birthdays and occasions of people you care about, and suggests gift ideas. Some suggestions link to third-party retailers via affiliate programs.

3. Your account

  • You must be 16 or older to create an account.
  • You are responsible for activity that occurs under your account.
  • Keep your sign-in credentials secure and notify us of any unauthorised use.

4. Acceptable use

You agree not to:

  • Use the Service to harass, harm, or impersonate any person.
  • Upload unlawful, abusive, or infringing content.
  • Attempt to reverse engineer, scrape, or interfere with the Service.
  • Use the Service to send unsolicited marketing.

5. Third-party products & affiliate links

Gift recommendations link to third-party retailers (e.g. Amazon Australia). We are not the seller of those products and are not responsible for stock availability, pricing, fulfilment, returns, warranties, or any disputes arising from your purchase. Your transaction is governed by the retailer's terms.

We may earn a commission on qualifying purchases made via our links, at no additional cost to you. See our footer disclosure for details.

6. Your content

You retain ownership of the people, notes, and preferences you add. You grant us a limited licence to store and process that content solely to operate the Service for you.

7. Service availability

We do our best to keep the Service running, but provide it on an "as is" and "as available" basis without warranties of any kind, to the maximum extent permitted by law. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be lawfully excluded.

8. Liability

To the maximum extent permitted by law, our liability for any claim arising out of your use of the Service is limited to AUD $100 in aggregate. We are not liable for indirect or consequential loss.

9. Termination

You can delete your account at any time. We may suspend or terminate accounts that breach these Terms or pose a risk to other users.

10. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Disputes will be handled in the courts of that jurisdiction.
